PAYMENTS: Once Sam’s Dock has accepted a signed Charter Agreement and payment is processed, there are no refunds.  Once payment has been processed, a non-transferable, non-refundable reservation will be reserved in your name for the dates and times stated in your reservation confirmation email, detailing your rental choices. It is your responsibility to verify that this information is correct.  A reservation is ONLY confirmed and secured after receipt of all requested payments have been made.

PARTIAL PAYMENTS: The total charter amount due is required to confirm and secure a reservation.  If you choose to pay a minimum down payment of half, your reservation will be confirmed, but not secured.  The balance MUST be paid no later than 30 days prior to your reservation departure to secure your reservation.  Failure to pay the balance by the due date will result in the loss of your reservation and forfeiture of your deposit.

FORMS OF PAYMENT: Acceptable forms of payment are credit cards (VISA, Discover, MasterCard and American Express), Cashier’s Check or Money Order (payable to Sam’s Dock).  If reservations are made in person, cash will be accepted.  Personal or Business Checks are ONLY accepted 30 days or more prior to your reservation departure.  All non-profit organizations must provide an IRS certificate showing exemption status.  All payments are subject to the cancellation policy below.

FUEL:  Fuel is included on all charter/party boat rentals.

NO-SHOW POLICY:  There are absolutely no refunds for no-shows.  Failing to appear for your rental on the date and reserved time will result in loss of all monies paid.  Payments made cannot be credited towards a future rental or charter.

DAMAGE: A valid credit card number shall be retained and will be used to provide full compensation for facility to return said charter in as good condition as when received.  Compensation includes,  but is not limited to, reimbursement of articles damaged, missing or broken or need for excessive cleanup.  I authorize Sam’s Dock to charge my credit card for these items in such case.   In the alternative, or in addition to the charges to my credit card, Sam’s Dock, in its sole discretion, may demand that I pay such charges in immediately available funds such as cash or certified check.  The amount available on the balance of the credit card shall in no way be considered a limitation on the amount of damages, reimbursements or rental charges owed to Sam’s Dock.

TRANSFER FEE: A $100 transfer fee applies to all accepted cancelled or rescheduled reservations.  Transfer fees must be paid at the time of the reservation change.

CANCELLATIONS: If you must cancel your charter reservation, you must do so a minimum of 30 days prior to your reservation departure date in writing and your prepayment can be rolled forward one calendar year.  A transfer fee applies to all accepted cancellations.  Cancellations received less than 30 days prior to your reservation departure are subject to forfeiture of all prepayments.  Due to the limited quantity of available charters (and particularly the advance coordination nature of captain and crew), there are no exceptions to the cancellation policy due to personal emergencies.  *At Sam’s  Dock’s sole discretion, validation may be requested and/or accepted for medical and other emergencies.

RESCHEDULES: If you must reschedule your charter reservation, you must notify us at least 30 days prior to your reservation departure date in writing and your reservation may be rescheduled ONCE, based on availability.  The reschedule policy applies ONLY to the current season and will not be rolled forward to the following year.

If you must reschedule your reservation with less than 30 days notice, a transfer fee applies, charter eligibility for a future rain check is voided and the rescheduled date is based on availability.

If you must reschedule your reservation with less than 10 days notice, a transfer fee applies, charter eligibility for a future rain check is voided and the rescheduled date is based on availability and must be rescheduled on a weekday (Monday through Thursday)

INCLEMENT, UNSAFE WEATHER: The decision to cruise is based on safety and is not negotiable.  The Captain (licensed and governed by federal and/or state law) and the General Manager have the final say whether charter boats may safely leave the marina.  Inclement,  unsafe weather may include, but is not limited to, heavy rains, unfavorable winds and lightning.  In the event of inclement, unsafe weather, Sam’s Dock will issue a rain check.  Criteria for issuing a rain check is based on United States Coast Guard guidelines, local Aviation Advisory and National Weather Service watches, warnings and recommendations for your particular area, NOT the local weather forecast.  Rain checks are not issued simply because the weather is not ideal and they are NEVER issued in advance.  (Keep this in mind when considering hiring caterers and DJs, etc)

RAIN CHECKS: Rain checks secure a prepaid reservation for a full year without penalty.  Rain checks are expired unless redeemed, and used, within 365 days from the date of original charter rental reservation date (not date of purchase, as many are paid for weeks or months in advance).  The full value of the rain check must be used upon redemption.  There is no cash value of unused portion of rain check.  Rain checks are NEVER issued in advance.  Rain checks are not issued for partial cruises.  The option to have a charter dockside will be offered in bad weather scenarios.  By choosing to stay dockside, charter rate is reduced by 25% and a refund will be issued within 10 business days or less. A cruise of any length of time voids the dockside reduced rate.

CHECK-IN: You must provide a current driver’s license (or passport) along with a valid, major credit card bearing your name at the time of check in to keep on file in case of damages, lost items and/or late fees. They MUST match the name on the charter rental agreement and a liability waiver must be signed upon arrival.  Failure to provide necessary documents will forfeit your charter reservation.

RESERVED TIME, DEPARTURE / RETURN: If you fail to show for your reservation, it will be forfeited.  Rental time starts and ends at the time reserved.  Please check in 30 minutes prior to your reserved time to complete paperwork and orientation with your captain and/or crew.  Time lost due to late arrivals,  decision to wait for guests, etc or early returns will not result in an extension of time,  refund or rain check.  The boat will board at the start of your reserved time and all passengers and belongings must be off the boat at the end of your reserved time; there is a 15 minute grace period, otherwise additional late fees will be incurred.  The Tejas Event boat offers a 30 minute grace period before additional late fees are incurred.  (Inform your guests to arrive 30 minutes prior, but no earlier, and we will begin to board early if possible).

TICKET SALES, VENDORS & EVENT PLANNERS: Public ticket sales is strictly prohibited unless prior approval by Sam’s Dock, in writing, is obtained. If Sam’s Dock has not approved your ticketed event, your trip is subject to forfeiture upon awareness of ticket sales. There are no refunds or rain checks if trip is cancelled for breach of contract. Charters that are venues for third party events are subject to an application process for validation. Additionally, all charters MUST be reserved by the event coordinator, either personally, or in the name of the event coordinator’s company.  It is the event coordinator’s responsibility to protect the interests of his/her company with safeguards, including but not limited to, liability insurance, customer policies, terms and conditions. There are NO EXCEPTIONS and Sam’s Dock will not be held responsible to any individual third party customers.

INDIVIDUALS are also strictly prohibited from selling tickets without written approval on file.  Remember,  you are responsible for your guests and their behavior; it is critical that you know exactly “who” you are inviting aboard your trip.  Otherwise,  one of your guests could very likely end your trip prematurely.  There are NO EXCEPTIONS.    

TEJAS LUXURY EVENT BOAT: There is NO water access from the Tejas Luxury Event Boat.  That means,  there is NO swimming from the Tejas Luxury Event Boat at any time. It is not equipped properly, or lawfully, for swimming.  An on board generator with 110 volt outlets is provided.  Guest is responsible to bring any and all necessary cords needed to reach outlets.

PASSENGER CAPACITY: Each Charter Boat has a United States Coast Guard specified capacity.  Everyone that boards the boat, whether a caterer, DJ, infant or any other guest must be counted as a passenger. This is STRICTLY ENFORCED as it is mandated by the Texas Parks & Wildlife Department and United States Coast Guard. It’s not a Sam’s Dock rule, so please do not ask us to bend it because we cannot, and will not.  NO EXCEPTIONS.  Each boat’s capacity, (captain and crew not included) is the following:

SWIMMING CHARTER BOATS: All swimmers MUST come out of the water at sunset by law.  There is NO LIFEGUARD ON DUTY, so you agree to swim at your own risk.  We cannot force you to wear a life jacket when swimming, but we HIGHLY RECOMMEND that you do.  Our captain and crew are procedurally trained  according to Texas Parks & Wildlife Department standards to keep you and your guests safe.  They are not there to grill your food, or serve your guests, as this compromises safety protocol.  You must obey ALL on-board, posted boat rules, or your trip is subject to forfeiture.  Fishing is prohibited on all charter boats, as it requires a special license.

BEHAVIOR: While on Texas inland waters (the lake), the Captain of your vessel (charter boat) is the authoritative decision maker in all scenarios and is governed by both State and Federal law, enforced by the local Denton County or Tarrant County Game Wardens.  You will listen to and obey all of their directives.  All laws that apply on land, also apply on inland waters. IF IT IS ILLEGAL IN THE STATE OF TEXAS, IT IS ILLEGAL ON OUR BOAT.  Please do not make the mistake of bringing drugs on board, as the captain and crew will immediately report it to the local authorities and your boat will return to dock where they will be waiting.  Please also make sure that you have a plan for that one person who threatens to end your trip prematurely due to unacceptable behavior.  Threatening the captain or crew and/or violating these policies will result in immediate forfeiture of the rest of your trip.

INDEMNITY WAIVER AND RELEASE OF LIABILITY AGREEMENT – TEXAS

DISCLAIMER

This Waiver and Release is applicable to all renters, operators, passengers, and users of equipment provided by Sam’s Dock (FOR PURPOSES OF THIS WAIVER AND RELEASE, THE TERM “SAM’S DOCK” INCLUDES ALL EMPLOYEES, AGENTS, REPRESENTATIVES, SERVANTS, ASSIGNS, SUCCESSORS, INSURERS AND SUBSIDIARIES OF SAM’S DOCK). If any other rental agreement is executed with this Release, the provisions of this Release will prevail over any clauses in the rental agreement that are inconsistent with this Release. The undersigned agrees that he/she is also signing this Release as the guardian or agent of undersigned’s minor children and users of said rental equipment. Renter agrees that he/she will disclose to Sam’s Dock all potential operators, passengers, and users of said rental equipment. Renter further agrees that in the event that he/she fails to notify Sam’s Dock of all potential operators, passengers, or users of said equipment, or misrepresents the certifications of anyone between the age 16-18, he/she will be personally liable for any damages to the undisclosed individuals, EVEN IF SUCH DAMAGES ARISE OUT OF THE NEGLIGENCE OR FAULT OF SAM’S DOCK

EXPRESS ASSUMPTION OF RISK – CAUTION!! READ BEFORE SIGNING

The undersiqned acknowledqes that the operation or use of a watercraft has inherent risks that may lead to bodily iniury or death. I further understand that I am not bound or required to participate in anv of the activities presented to me, but have willinqly and voluntarily decided to participate. I have no health restrictions which would prevent me from participatinq in anv activities or enterinq into this aqreement. I realize that I am free to refuse to participate in anv of all activities including those I feel uncomfortable with or which I feel cannot be completed safely by me. I knowinqlv and voluntarily assume all risk of injury, illness. damage or loss, both known and unknown. associated with the rental operation, or use of the watercraft or associated rental company. even if arisinq from the negligence, act, or omission of LESSOR, and assume full responsibility for my participation, EVEN IF THE RISKS ARISE OUT OF THE NEGLIGENCE OR FAULT OF SAM’S DOCK

WAIVER 1 RELEASE OF LIABILITY

By the execution of the Release, the undersigned agrees that Sam’s Dock shall not be liable for any damages arising from personal injuries sustained by the operators or passengers of the craft, including any minor children under the undersigned’s custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Sam’s Dock The undersigned assumes full responsibility for any such injuries or damages which may occur and further agrees that Sam’s Dock shall not be liable for any loss or theft of personal property. The undersigned specifically agrees that SAM’S DOCK SHALL NOT BE RESPONSIBLE FOR SUCH INJURIES, DAMAGES, LOSS OR THEFT, EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY SAM’S DOCK, whether such negligence is present at the signing of this Release or takes place in the future.

LIABILITY TO THIRD PARTIES

The undersigned hereby agrees that he/she will indemnify and hold harmless Sam’s Dock for all personal injuries, property damages, or any other damages to any and all third parties, including, but not limited to, operators and passengers of other watercraft and minor children under the undersigned’s custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Sam’s Dock, EVEN IF SUCH DAMAGES ARISE OUT OF THE NEGLIGENCE OR FAULT OF SAM’S DOCK

ACKNOWLEDGMENT OF WAIVER AND RELEASE

The undersigned states that he/she has had sufficient time to review the Waiver and Release and to ask any questions associated with said Release. The undersigned understands that employees and agents of Sam’s Dock are not attorneys and will not provide legal advice as to the legal interpretation of this agreement. The undersigned further states that he/she has carefully read the foregoing Waiver and Release, knows the contents thereof, and has signed this Release as his/her own free act. The undersigned warrants that he/she is aware that he/she may rent, operate, or use equipment from another rental facility, but has chosen to rent, operate, or use equipment from Sam’s Dock with the knowledge that signing this Release is a requirement for rental operation, and use of said equipment. THE UNDERSIGNED FURTHER WARRANTS THAT HE/SHE IS FULLY AWARE THAT HE/SHE IS WAIVING ANY RIGHT HE/SHE MAY HAVE TO BRING A LEGAL ACTION TO ASSERT A CLAIM AGAINST SAM’S DOCK FOR SAM’S DOCK’S NEGLIGENCE.

INDEMNITY AGREEMENT

THE UNDERSIGNED AGREES TO INDEMNIFY, HOLD HARMLESS AND DEFEND SAM’S DOCK IN ANY MATTER AND FROM AND AGAINST ALL CLAIMS, DAMAGES, LOSSES, AND EXPENSES, INCLUDING ATTORNEY’S FEES ARISING OUT OF AND/OR RELATING TO THE RENTAL OPERATION AND USE OF ALL EQUIPMENT PROVIDED BY SAWS DOCK INCLUDING BY NOT LIMITED TO ANY NEGLIGENT, GROSSLY NEGLIGENT AND/OR INTENTIONAL ACT OR OMISSION OF SAM’S DOCK

IMPORTANT SAFETY NOTICE:     IN-WATER ACTIVITIES ARE PROHIBITED AFTER SUNSET. (There is NO water access from the Tejas).

ATTENTION: A cruise of any length of time voids the dockside reduced rate

CHARTER RENTAL TERMS & CONDITIONS:

CHARTER RENTAL: Sam’s Dock has accepted a non-transferable, non-refundable reservation in your name for the dates and times stated in your reservation confirmation, detailing your rental choices. It is your responsibility to verify that this information is correct. A reservation is confirmed ONLY after receipt of all requested prepayments reservation by to the any due applicable dates shown.

All Non Profit organizations must provide an Internal Revenue Service Certificate showing exemptions status. All payments are subject to the cancellation policy as follows.

TRANSFER FEE: If you MUST reschedule your charter booking due to a conflict with your original reservation date, you may do so at least 30 days prior to your reservation date based on availability during the same calendar year. You may transfer your booking to the next calendar year if more than 30 days prior to your original reservation date for a $59 non-refundable transfer fee. Transfer fees must be paid at the time of date change.

TAXES: Sales and local taxes are subject to change. You will be assessed the sales tax that is in effect at the time of your event departure date, regardless of when your reservation was made.

DAMAGE DEPOSIT (REFUNDABLE): A $500 refundable damage deposit is required at check in. A valid credit card number shall be retained and will be used to provide full compensation for facility to return said charter in as good condition as when received. Compensation includes, but is not limited to, reimbursement of articles damaged, missing or broken. I authorize Sam’s Dock to charge my credit card for these items in such case. In the alternative, or in addition to the charges to my credit card, Sam’s Dock, in its sole discretion, may demand that I pay such charges in immediately available funds such as cash or certified check. The amount available on the balance of the credit card shall in no way be considered a limitation on the amount of damages, reimbursements or rental charges owed to Sam’s Dock. I hereby acknowledge and understands that the watercraft is without damages or defects including, but not limited to, dents, scratches, tears, stains and propeller damage. An inspection of the watercraft will be conducted by both parties prior to the start of the Charter whereby any existing damage will be noted and acknowledged in writing on the inspection form. Upon return of the Charter, Sam’s Dock will conduct a final inspection. I will be held responsible and liable for the total cost of any and all damages to the Charter that were not noted during the initial inspection. Sam’s Dock has up to 48 hours after the rental & prior to being rented again to discover and inform me of damage found.

NWS (National Weather Service) watches, warnings and advisories will be acknowledged and followed.

RAIN CHECKS FOR CHARTERS: Rain checks secure a prepaid rental for a full year without penalty. Rain checks are expired unless redeemed within one year. The full value of the rain check must be used upon redemption. No cash value of refund for unused rental. Rain checks are never issued in advance and must have corporate approval to be valid. Rain checks are not issued to charters that leave the dock and then experience weather related returns. Any partial use of boat or time in a cruising capacity voids rain check or refund eligibility. The option to have a charter dockside will be offered in bad weather scenarios. By choosing to stay dockside, charter rate is reduced by 25% and a refund will be issued within 10 business days. Dockside charters must have management approval. Seasonally, the Tejas Houseboat is equipped with Isinglass, a custom enclosure for the upper deck offering protection, visibility and comfort.

DEPARTURE I RETURN OF YOUR CHARTER BOAT: So that you can best plan to meet the scheduled return time for the Tejas Houseboat, you should allow 30-45 minutes for charter unloading. NOTE: Please be sure to discuss procedures for all watercraft in detail with your instructor prior to leaving the dock to understand what is required when returning watercraft vessel. If early departure is needed, it may be prudent to return dockside well ahead of posted check out time. Charters must completely vacate the boat within 30 minutes of return; otherwise, additional fees will be incurred have read and understand all guidelines and agree to the listed terms.

WARNING: There are significant elements of risk in any adventure, sports or activity associated with the outdoors, the presence of use of motorized watercraft and activities on, in and around water. Certain risks cannot be eliminated without destroying the unique character of the activity.

EXPRESS ASSUMPTION of RISK and RESPONSIBILITY: l/we assume the risk(s) of personal injury, accidents, illness, or death, including but not limited to sprain, torn muscles, and/or ligaments; fractures; eye damage; cuts, wounds, scrapes, abrasions and/or contusions, dehydration, drowning, exposure; head, neck, and/or spinal injuries; bites, stings and/or allergic reactions; shock, paralysis or death. I/we agree to assume responsibility for the risks identified above and any risk not specifically identified. My/our precipitation in this activity is purely voluntary. I/we verify that I have no health restrictions which would prevent me from participating in any activities, I am not under the influence of drugs or alcohol and sufficiently qualified and capable of participating in the activities. Therefore, I assume full responsibility for any injury that myself, my guest, and any minor children, whether mine or another of the participants, for bodily injury, accidents, illness, death, loss of personal property, and expense thereof as a result of any accident that may occur. We agree to hold you and your agents and employees harmless and waive any right of subrogation I/we may have. l/we elect to participate in spite of the risk.

THEREFORE, In consideration of the services or property provided, l/we for myself and any minor children for which I am responsible, and for any of my heirs, personal representatives or assigns RELEASE Sam’s Dock LLC and their principals, directors, officers, agents, and employees AND STIPULATE that they shall have no liability of any nature for any and damages to me and the other persons and property I may use, as a result of any acts, omissions or negligence of Sam’s Dock LLC or any other person or entity connected to those persons and entities, and hereby release, discharge and agree to hold Sam’s Dock LLC and their insurer or other affiliates, if any harmless for any such damage.

COVENANT NOT TO SUE – CAUTION!! READ BEFORE SIGNING
As part of the consideration for using the chartered or rented equipment, I promise not to sue or make a claim against SAM’S DOCK, LLC for any damage or loss suffered as a result of my participation in the rental activities. It is the intent of this rental agreement to fully and completely release SAM’S DOCK, LLC from all claims.

I understand the NO LIFEGUARD will be on duty. I, and any minor children in my charge, will swim at our own risk.

By submitting a reservation online, in-person, or by phone, you agree to Sam’s Dock Terms & Conditions, and agree to be bound by them.

PARKING

Plenty of parking is available, and it is within walking distance to our docks.  Please park in the ‘Guest Parking’ area only.  Your vehicle will be towed by marina staff if parked in the lower, members parking lot.


CAPACITY

Each boat has a specified capacity which includes caterers and entertainment.

This does not include our Captain and Crew so please do not book or bring additional guests as they will not be allowed to board. NO exceptions due to U.S. COAST GUARD.  See capacity below:

LOADING/UNLOADING AREA

The first ramp in the parking lot has carts available for you and your caterers.  Have them use this ramp and not the one with stairs.  Once unloaded–move vehicles to the upper parking lot.

Depending on what you booked, all items will already be loaded on your boat. Please let the Captain know if anything is missing. Extension cords are not provided.

WHAT TO BRING

We provide trash bags and paper products for the restroom.  Caterers need to bring their own supplies for serving including paper towels and cleaning products, etc. We provide one ice chest and we sell ice at the ship store for $3.00 per 10-lb bag.
